The officers were investigating a string of 4 robberies committed by a single perpetrator. Perpetrator’s DNA did not match that of the plaintiff and one witness identified someone else during a photo-array. Nonetheless, P.O. Montas forced Plaintiff to draft a confession by threatening him. P.O. Montas said he would blow Plaintiff’s brains out and tell everyone that he had attempted to steal P.O. Johnson’s weapon if he did not write out a confession. Description: Before the incident date, defendants were investigating a number of commercial robberies in Bedford Stuyvesant, Kings County in April 2015. On the incident date, the plaintiff was arrested, imprisoned, and later gave a false and coerced written confession. Defendant Det. Montas told the plaintiff that he would get shot unless he wrote a confession under Montas' guidance. This confession led to the plaintiff's unlawful arrest. The plaintiff was acquitted of all charges after 17 months in jail.

Description: Plaintiffs were arrested at a street corner by defendant officers. Said officers then recovered a firearm from a nearby motor vehicle's rear wheel well. Plaintiffs were said by the officers to have confessed to owning the weapon. Plaintiffs were transported to 75th Precinct. Each plaintiff was strip searched. Both were charged with Criminal Possession of a Weapon in the Second Degree, and Criminal Possession of a Weapon in the Fourth Degree. Both plaintiffs were ultimately acquitted of all charges.

Description: Defendant officers approached Plaintiffs while they were sitting in their father's car, unlawfully arrested them, took them to the 75th Pct, and charged them with PL 220.03, Criminal Possession of a controlled substance in the seventh degree, which were subsequently ACD'd against both plaintiffs. Five days later, defendant officers entered Plaintiff's apartment, threw him to the ground, searched him and the apartment, and took him to the 75th PCT. Plaintiff was charged with 265.03, which was eventually dismissed.
