Description: On September 8, 2012, Defendants, Police Officer Michael Brooks, PO Vargas, and Lieutenant Daniel Divers falsely arrested, charged, and maliciously prosecuted Plaintiff with Robbery in the Second Degree in Kings County. After the Plaintiff (and his co-defendant) were indicted and subsequently incarcerated, counsel for the co-defendant obtained a surveillance video from a location near where the alleged crime occurred. In the video, two individuals are seen running from the alleged crime scene. Neither of those two individuals matched the physical appearance of Plaintiff or the co-defendant. Description: On February 11, 2013, at approximately 3:00 a.m., plaintiff was approached by defendant NYPD officers Michael Brooks and John Cirelli and asked to leave a certain area. Plaintiff exp;lained that his car was blocked in by the officers' cars. He was told he still needed to leave and complied. He returned to get his car approximately 20 minutes later once the officers drove away but as he was about to get into his car, the officers returned and arrested plaintiff. He was arraigned on false charges of obstructing governmental administration and reisting arrest based on false statements by defendant Brooks. Plaintiff had to return to court three times until all charges were dismissed on July 31, 2012.

Description: On March 7, 2010, Plaintiff was leaving a friend’s apartment when officers stopped him in the hallway. Plaintiff provided the friend’s information but the officers arrested him for trespass and took him to the 120th Precinct. Defendant Officer John Fahim swore the false affidavit. All charges were dismissed on May 18, 2010.
On January 28, 2012, Plaintiff was leaving his girlfriend’s apartment early in the morning when officers stopped and arrested him for trespassing, notwithstanding the officers knowing about the relationship. Plaintiff was held until the afternoon of January 29, 2012, when he was released with no charges have been filed.
