Description: On February 4, 2017 Plaintiff Stider Tertus parked his vehicle at a curb to pick up food. Officer Sean Rafferty approached and said he was parked too close to a fire hydrant. When Plaintiff moved his vehicle and exited, Rafferty approached again demanding driver's license and asking Mr. Tertus if he had been drinking or smoking marijuana. Mr. Tertus said no. Plaintiff had two unopened cans of beer on the floor of the front passenger seat and Rafferty arrested him. At the 112th precinct, Mr. Tertus registered 0.00 on a breathalyzer and a urine sample later failed to detect presence of drugs.
