Defendant Officers arrived and arrested Plaintiff at his home, took him to the 105th Precinct, and charged him with Assault in the third degree and Harassment in the second degree. Description: On November 14, 2013, Plaintiff was inside her kitchen while gardeners were outside working on her lawn. Plaintiff was a tenured guidance counsellor with the DOE on bed rest medical leave during her seventh month of pregnancy with twins. Plaintiff went to her lawn to mediate the dispute with a neighbor, Defendant Ernst Jabouin, about leaves being blown across the street. Plaintiff was holding the potato peeler she had been using, but Defendant Jabouin accused her of having a knife. Because of the threats Plaintiff went in and called 911.
