Complaint
Description: On July 1, 2012, plaintiff was lawfully present at the corner of 149th Street and 116th Avenue in Queens, NY. Plaintiff was smoking a cigarette. A police vehicle pulled up alongside plaintiff. Tiernan stated he smelled marijuana. Plaintiff informed Tiernan he was smoking a cigarette. Three officers exited the vehicle and approached plaintiff. Tiernan, observing plaintiff was holding a beverage, demanded to know what he was drinking. Plaintiff replied that he was drinking cranberry juice and showed the bottle he was holding. Another officer demanded to know where plaintiff lived. Plaintiff produced ID. Tiernan informed plaintiff the officers smelled marijuana and plaintiff was holding an open container. Plaintif...
