Complaint
Description: On September 4, 2013, Plaintiff was driving his vehicle in Kings County, New York. An NYPD officer threw his flashlight at Plaintiff’s vehicle, striking the driver’s-side window and causing the window to shatter. The shattered glass struck Plaintiff’s face and arms, causing lacerations. Plaintiff pulled his vehicle to the curb. Plaintiff could see two NYPD officers—including Scott DeFalco—walking away from his vehicle. Plaintiff called 911 for assistance. Officers arrived and arrested Plaintiff. Plaintiff was arraigned on charges he alleges were falsified by Officer DeFalco. The charges against Plaintiff were dismissed and sealed following an ACD.
