Description: On May 20, 2014 Gunina was enjoying a day at Brighton Beach with a friend when they were approached by Pos Maxim Kats and Hameed Assaidi who without explanation grabbed and handcuffed Gunina’s friend. Gunina protested and asked P.O.s why they were manhandling her friend, she was ignored and they jumped onto Gunina’s friend in furtherance of their aim to handcuff her. Gunina began to use her cell phone to record the use of force by Kats and Assaidi on her friend. Kats and Assaidi, upon seeing they were being recorded, grabbed Gunina and wrestled her to the ground. Description: On April 22, 2013 plaintiff was driving home from work and stopped at a red light. At the light, officers Acierno and Assaidi pulled up behind plaintiff and turned their lights and siren on. Plaintiff immediately pulled over to the curb. Officers then approached and asked for his license. Plaintiff asked if he had run a red light and Acierno told him he was stopped because he was wearing a bandana that covered the lower half of his face and because his music was too loud. The covering on his face was used during work while putting down asphalt.
