Description: On May 21, 2012, Sally Nieves (Plaintiff), who uses a walker to ambulate, was at her 2nd floor apartment in Staten Island when a dispute arose with her son and police responded. Police (Mullarkey) started to struggle with the son, and soon 10 police officers (Mullarkey & Does) were attacking the son.
Plaintiff was pepper-sprayed, struck about the head, face, body, and limbs with fists, kicks, and baton, eventually pulled to the floor. Plaintiff felt pain throughout her body: left arm, eyes, head, and suffered a post traumatic seizure. Plaintiff was held in hospital in restraints until May 29, 2012, when taken to court for arraignment. She was unable to see visitors or bathe while in the hospital.
