Description: On July 9, 2014, Plaintiff was at work at his optometry store when an employee told him that a sanitation officer came to the store to say that she found a trash bag in front of the adjacent business that she believed belonged to the Plaintiff’s business. Plaintiff went outside to speak with New York Sanitation Enforcement Agent Ilva Harrigan and Harrigan said that she looked in the bag and saw that some of the contents were from Plaintiff’s optical store, she told Plaintiff that the bag should not have been left on the street during the day.
