Description: On September 14, 2013, plaintiff was lawfully present on W. 119th Street, New York, NY. Defendant Kucyk, in plain-clothing at that time, approached plaintiff and demanded identification. Defendant Velez, also plain-clothed, punched plaintiff in the face when he tried to remove his hands from his pockets while attempting to obtain his identification. Other defendant officers then physically seized plaintiff, who was again punched in the face.
