Description: On August 22, 2013, plaintiff Carlos Mercado, was arrested, and arraigned the next day in Kings County Criminal Court. Mercado was transported to Riker's Island. From the time of his arrest, until his death on August 24, 2013, Mercado informed defendants he had diabetes and required and requested medical attention, while demonstrating physical signs of medical distress including vomiting and falling unconscious on the floor. Defendants never provided medical care that Mercado repeatedly requested. On August 24, 2013, Mercado went into a diabetic coma and died shortly afterwards never having regained consciousness. The City of NY Medical Examiner determined Mercado's cause of death was Diabetes Mellitus.
