Description: On January 21, 2014, Plaintiff was arrested by police officers, including Detective Emily Rivera, when she was lawfully present at the premise 333 Broadway, Apartment E7E, New York. She was unlawfully searched and handcuffed. Plaintiff was taken to the 25th Precinct and then to a detention facility in Bronx. Plaintiff was charged with criminal possession of a controlled substance in the third degree and criminally using drug paraphernalia in the second degree. Plaintiff was fingerprinted, photographed, and interrogated without cause. She was made to strip down her bra and panties when searched.

Description: On or about October 10, 2012, Plaintiff was lawfully present and asleep in his girlfriend's apartment. Defendant NYPD Detectives Nelson Pabon and Emily Rivera kicked down the door with guns drawn, and Plaintiff was immediately arrested with his arms tightly behind his back and transported to a nearby precinct where he was charged with Criminal Possession of a Weapon. Defendants did not have probable cause or any reason to believe these claims may have been true, and filed false and/or misleading police reports and forwarded them to prosecutors at the New York County District Attorney's Office, including that Plaintiff possessed a weapon.
