Description: On March 11, 2012, Plaintiff was thrown out of a concert by a security guard for allegedly smoking marijuana. When Defendant Officer Matthew Rosato arrived and asked for identification, Plaintiff produced his Colorado drivers license. Plaintiff questioned Defendant Officer Rosato’s attitude toward him, at which point Defendant Officer Rosato grabbed the Plaintiff’s arm. Plaintiff was able to free himself and escape into the crowd. Defendant Officer Rosato then filed false disorderly conduct charges against Plaintiff. Plaintiff learned about this when he received a letter at his Colorado address stating that on May 31, 2012 the charges had been dismissed.
