Description: On January 18, 2013, plaintiff JOSE MARTINEZ was lawfully in front of premises 935 Ogden Avenue, Bronx, New York. Defendant NYPD officers unlawfully and without reasonable suspicion or probable cause approached plaintiff and arrested him. The plaintiff was taken to the 44th Precinct, and subsequently to Central Booking Bronx County, City and State of New York, where he was arraigned on January 19, 2013, on charges of Criminal Possession of a Controlled substance and released on his own recognizance.
On July 2, 2013, all charges were dismissed. As a result of the foregoing, plaintiff, sustained emotional distress, embarrassment, and humiliation, and deprivation of his constitutional rights.

Description: Plaintiff, a black male, was walking down the street when plainclothes officers stopped him, threw him against their unmarked car, and brought him to the precinct where he was strip-searched. No drugs were found but Plaintiff was falsely accused of 220.39 criminal sale of a controlled substance; 222.06(1) criminal possession of a controlled substance; and 220.03 criminal possession of a controlled substance. Charges were eventually dismissed.
