Description: On May 26,2020, Defendants Andy Urena and Michael Dunn, possibly accompanied by Defendants John/Jane Doe 2-4, arrived at Concourse House, a shelter overseen by DHS where Plaintiff Ms. Roundtree lives in a private apartment. Defendants asked Defendant Emily Vega, Concourse House Security Agent, if they could enter the shelter to arrest Plaintiff without presenting a warrant or Vega asking for a warrant or taking any other measure to confirm whether the Defendant officers had a warrant. Defendant Vega escorted the Defendant NYPD officers to Plaintiff's apartment, bringing a key to unlock Plaintiff's private residence and unlocking it without knocking on the door. Description: On January 5, 2013, Plaintiff was stopped and frisked by Defendant Officers Urena, Apostolou and John Doe. The search yielded Plaintiff's prescription medication but the Defendant Officers arrested him anyway. At the time of his arrest Plaintiff was wearing a back brace for severe back pain. While in custody Plaintiff removed the brace to use it for head support while resting but when Defendant Officer Jane Roe woke him up, she refused to allow Plaintiff to put the brace back on and then assaulted him. Plaintiff lost consciousness as a result of the attack and would again lose consciousness after falling down a flight of stairs while handcuffed. All charges were dismissed.
