Plaintiff was placed in a black car and driven around for about 4 hours before being taken to the 40th precinct. He was questioned by officers including defendants Monge and/or Chevere. Officer Chevere showed numerous photos to the victim of a crime. Chevere was aware that the victim was unable to adequately describe her attacker by age or other physical characteristics. However, CHEVERE knew that the victim described her attacker as 6’,1”. Description: On July 25, 2013, Plaintiff was walking on the street along W 165th Street in Bronx, where he was chased by three unknown men. After running for about 3 blocks, Plaintiff recognized them as police and he was wrestled down to the ground and kicked in repeatedly in his stomach, as well as gun butting in the head. Plaintiff was handcuffed and brought to the 44th precinct. Plaintiff was charged with felony level possession of a controlled substance and was unable to pay the bail and was incarcerated for six days. Ultimately, the criminal charge was dismissed in Plaintiff's favor on August 20, 2013.
