Description: On March 2, 2020, Plaintiff Tracy McCarter was visited at her Manhattan residence by her estranged and abusive husband, James Murray. Mr. Murray had an extensive history of alcoholism and domestic violence toward Plaintiff. Plaintiff returned from work to find Mr. Murray waiting for her outside her apartment, at which point she allowed him inside to retrieve his medications and sleep on the couch. Once inside, Mr. Murray became combative towards Plaintiff. Mr. Murray pushed Plaintiff into a mirror and choked her. Plaintiff attempted to deter the attack by brandishing a sharp knife, at which point Mr. Murray tripped while lunging towards her. Mr. Murray fell into the knife, and the blade entered his chest.
