Description: Defendant Officers forcibly entered Plaintiff's 1st floor apartment with a search warrant obtained for another apartment in a two-story home. Officers allegedly recovered contraband in the 2nd floor apartment, but still arrested Plaintiff who lived in the apartment below, took him to the 123rd Precinct, charged him with Possession of a Controlled Substance and Possession of Marijuana in the Second Degree, which were later dismissed.
