Plaintiff was kicked and hit multiple times for two to four minutes while laying on the ground in the fetal position. During the assault, one of the men yelled "Where's the gun?" repeatedly, to which Plaintiff replied, "I don't have a gun!" One of the officers eventually shouted, "He has no gun!" Description: On October 2, 2013, plaintiff Hicks was stopped outside of his car by a plain clothes detective under the supervision of defendant Lt. Barone. Plaintiff Hicks ran away. When he returned to his home later, he discovered that defendant Barone and other unnamed defendant officers had ransacked his home under the pretense of a search warrant for a gun. Defendant officers damaged the front door and broke an urn containing the ashes of plaintiff Hicks' father. At the same time, other defendant police officers surrounded plaintiff Dingle, who had remained in plaintiff Hicks' car.
