Description: While leaving the residence, plaintiff confronted plain clothes defendant officers. Defendant officers searched plaintiff's backpack with his permission. Defendant officers failed to give plaintiff time to examine their ID and plaintiff began to walk away; defendant officers surrounded plaintiff who acted defensively by swinging his fist. Defendant officers continued to physically assault plaintiff causing injury. Defendant officers charged plaintiff with assault in the third degree, menacing in the third degree, obstructing governmental administration in the second degree, resisting arrest and harassment in the second degree. All charges were dismissed.
