Description: On February 20, 2014, Plaintiff Carlos Quiles was driving to pick up his cousin, Plaintiff Carlos Rodriguez, to bring him to the hospital when he was pulled over by a police car. An officer approached Quiles, told him his rear tail light was blinking, and asked for his driver’s license and registration. Quiles produced his driver’s license and registration, and the officer opened the rear passenger door of the vehicle and removed a bottle from the pocket of the passenger seat and asked what it was. Quiles responded that it was his daughter’s drink, “Malta.” The officer asked if he had been drinking and Quiles said he had not.
