Description: On July 17, 2012 at approximately 10:30am, Officer Guido, Sergeant Ciccarello and Officer John Doe, arrived in a white police van at 46th and 8th (midtown west/Times Square). Plaintiff Waleed Salama has a licensed mobile food business and his employee, Ayad Youssef was working on the cart. An argument with police ensued. The police physically moved the cart even though there was no violation. The police put their hands on plaintiff and plaintiff's employee, pinning plaintiff to the ground and stepping on plaintiff's neck for three minutes. The camera phone was borrowed from a bystander and the police were heard stating "don't give the phone back." The plaintiff's food cart was confiscated and the contents...

Description: On July 28, 2014, Plaintiff was in Times Square, where he held his cell phone in the direction of PO Ryan Lathrop as if he were recording him. PO Lathrop was then propositioned for a picture by a group of tourists, after which he approached Plaintiff, reached in Plaintiff's pockets, and pulled out a juice bottle--he claimed it contained alcohol. Plaintiff protested this invasion of privacy, stating that it was not in plain view and did not contain alcohol, to which PO Lathrop responded that, essentially, "it is in plain view now."
