Description: Plaintiff was a passenger inside a car he believed to be a taxi when the defendants, P.O. D'Amico and P.O. Ardolino, ordered the driver to immediately pull over. The driver pulled the car over and ran away while the plaintiff stuck his hands out the window so the police could see he was unarmed. Plaintiff was instructed to get out the vehicle at gunpoint and was punched in the head by P.O D'Amico while P.O. Ardolino placed his knee on the plaintiff's neck while on the ground for supposedly resisting. Defendants took the plaintiff to the 75th precinct where the plaintiff complained about the way he was treated. A Caucasian member of the NYPD told the plaintiff "Little n****r, what are you going to do about it?" ...

Description: On March 13 2013 inside the Atlantic Center Shopping Mall, NYPD officers Kelly Brown stopped, pushed, and searched Plaintiff pursuant to an unlawful practice of stopping and searching individuals due to discrimination against them based on race/nationality and not for a particularized suspicion that plaintiff was engaged in criminal activity. Plaintiff was standing outside talking on her cell phone when Officer Brown told her to exit the mall. Plaintiff responded that she was a taxpayer and asked why she was being asked to leave the mall. Officer Brown pushed plaintiff in the chest, kicked her shopping bags, and told her to get out. Plaintiff tried to leave at this point but was handcuffed, her person and purse...
