Description: Plaintiff was charged with attempted robbery in the 1st deg, crim sale of a controlled substance in the 3rd deg, and other charges. Plaintiff was accused to selling a controlled substance to an undercover police officer and then attempting to rob the same undercover officer. Police officers then approached the scene and plaintiff immediately put his hands up when officers punched his stomach, kicked him in the head and face two times. He was charged with Criminal Sale of a Controlled Substance in the Third Degree and Criminal Sale of a Controlled Substance in the Fifth Degree. At no point did the defendants recover any contraband nor did the plaintiff commit any offense in the presence of the defendants. The plaintiff had to go to the hospital for an asthma attack that occurred during the arrest. All charges were dismissed.
