Description: On April 9, 2011, Plaintiff was heading towards a supermarket to shop for food when he was stopped and searched by Officer James Seder outside the supermarket. Plaintiff was not engaged in any suspicious activity and the stop and frisk was improper and unreasonable. Plaintiff was not in possession of any contraband or items that could reasonably justify his arrest. Not withstanding the lack of probable cause to arrest Plaintiff, Officer Seder handcuffed Plaintiff and transported him to the precinct. The DA's Office subsequently declined to prosecute Plaintiff.
