Description: The plaintiff was asleep on the couch with his girlfriend in his friend's apartment when the defendant officers entered the residence with a search warrant looking for the plaintiff's friend. The defendant officers then threw the plaintiff to the ground and arrested him. The plaintiff was charged for Criminal Possession and Criminal Sale of a Controlled Substance in the Third Degree with no evidence to support this. The charges were later dismissed after the plaintiff spent 72 hours in police custody.

The officers nevertheless arrested and handcuffed Plaintiff, without giving any reason for the arrest.
