Description: On January 16, 2018 at approximately 5:00PM in the vicinity of Webster Avenue and East 168th Street in the Bronx, NY, NYPD Narcotics Officers Anthony Dismone, Josh Kaveney, John Doe, and John Roe stopped, searched, grabbed, assaulted, battered, and detained Plaintiff Fancis Shane in an aggressive and excessive manner without an arrest warrant, probable cause, reasonable cause, or any legal justification. Plaintiff was subjected to a strip search and being photographed and fingerprinted. He was then arraigned, subjected to malicious prosecution, and remained incarcerated for over 24 hours. He was required to make numerous court appearances before all charges were terminated favorably.

Description: On December 7, 2012 Plaintiff was in the back seat of a parked vehicle in the Bronx. Defendant Officers Disimone and John Doe's 1-3 approached thee vehicle with guns drawn. The Defendants then pulled Plaintiff out of the vehicle, threw him up against said vehicle, handcuffed him, and subjected him to a pat down search. Plaintiff was arrested for criminal possession of marijuana yet the Plaintiff was not in possession of any marijuana. At the Precinct Defendants subjected Plaintiff to an invasive search, requiring him to remove his clothes and spread his legs. One Defendant Officer removes $1500 from Plaintiffs possession and gave him a voucher for $1009. The charges were dropped the following day.
