Description: On June 2, 2011, at approximately 9:00 a.m., plaintiff was wrongfully arrested without probable cause by NYPD Officers Sergeant Edward Taveras, Police Officer Carlos Marchena, and other officers at his residence in the Bronx. During his arrest, plaintiff was physically assaulted with a riot shield, grabbed by the neck, thrown to the ground, and subsequently stomped, punched, and kicked by the officers, resulting in bruises and lacerations to his face, head, and torso. He was wrongfully accused and imprisoned for over 24 hours on charges of Resisting Arrest and other charges, leading to several court appearances. On October 20, 2011, all charges against plaintiff were adjourned in contemplation of dismissal.

Description: On December 9, 2011, Plaintiff was lawfully inside the premises. Defendants, the NYPD members, unlawfully and without reasonable suspicion or probable cause, approached Plaintiff and arrested him. Plaintiff was punched, bitten, assaulted, and otherwise manhandled by Defendants. Plaintiff was taken to the 41st Precinct and subsequently to Central Booking in Bronx County, where he was arraigned on December 11, 2011, on charges of Criminal Possession of a Controlled and Resisting Arrest. Plaintiff was held in custody until December 16, 2011, when he was released on his own recognizance. Defendants caused Plaintiff to be prosecuted until May 3, 2012, when all charges were dismissed on the merits.
