Description: On April 6, 2013 Plaintiff Edwin Ceballos was arrested on charges that were eventually dismissed. Defendant POs Rosado and McCarthy handcuffed Plaintiff and held him in a police car but did not provide him with a seatbelt or any other safety in case of an accident. On the way to the precinct, a drunk driver (Anthony McClendon), who was driving a rental car from Enterprise, ran a red light and struck the police vehicle. Plaintiff's body bounced from he right side to the left side, causing his head and left side of his face to hit the divider side of the car. His neck also jerked and felt like it "snapped." Description: Defendant officer dressed in riot-gear, forcibly entered Plaintiffs' home under the guise of an alleged search warrant. Defendants then handcuffed plaintiffs and placed in the living room while police ransacked their home. The officers arrested Plaintiffs and alleged that small bags that Plaintiff used to store buttons, were actually ìdrug paraphernalia.î Plaintiffs were taken to a precinct, and given a DAT, which the DA declined to prosecute.
