Description: On December 24, 2011, Plaintiff was smoking a cigarette outside the office Christmas Party. He was working as a NYC Parks Department Employee. NYPD Police Officers Jesus Sosa and others approached. Plaintiff was told to "shut up and sit down" and his attempts at showing them his identification were ignored. Without lawful cause he was handcuffed and taken to the precinct and ordered to do a breathalyzer test. He refused, but agreed to do a coordination test. He was then falsely charged with a DUI.
