Description: On January 23, 2019, the Plaintiff was in his car when Defendant undercover NYPD officers Kaiser Surriga and Wayne Costello approached. Defendant Surriga approached from the passenger side, and Defendant Costello approached from the driver's side pointing a gun. With the gun draw, Defendant Costello requrested motor vehicle identification materials. The Plaintiff stated he was scared and that he would not reach for the materials in his glove box. The two Defendants broke the front and passenger windows on Plaintiff's vehicle with folding batons/clubs and pulled the Plaintiff through the window and slammed him to the ground.
