Description: On April 14, 2012, Plaintiff was lawfully on the street when approached by several officers, including Robert Maynard, Colleen Canavan, Juan Guzman, and Salvatore Desiano. The officers stopped Plaintiff without probable cause or reasonable suspicion to believe that he had committed any crimes or offenses. They pushed Plaintiff, punched him in the face, jumped on top of him and tackled him to the ground. Plaintiff was placed under arrest and transported to a hospital to be treated for his injuries. At the precinct, the officers falsely informed the DA's Office that they had observed Plaintiff commit crimes and/or offenses. Plaintiff's criminal charges were subsequently adjourned in contemplation of dismissal.

Description: On April 14, 2012, NYPD Officer Robert Maynard and Officers John Doe 1-10 approached plaintiff on a Brooklyn street. They unlawfully stopped plaintiff without reasonable suspicion or probable cause, and proceeded to assault/batter plaintiff with excessive force by punching him and tackling him to the ground (plaintiff was taken to the hospital for his injuries). The officers falsely arrested plaintiff. Charges were later adjourned in contemplation of dismissal. The actions of defendant officers were the result of the City's policy and custom of failing to properly train officers, and the City was negligent in the hiring and supervision of Maynard and the John Doe officers.
