Description: Plaintiff got into an altercation with his sister, who attacked him, when he left his house and went to a friend's. The sister called the police alleging that Plaintiff assaulted her and Defendant Officers, taking the story at face value, arrested Plaintiff and took him to the 32nd Precinct. Plaintiff was charged with assault and criminal mischief which were later dismissed because the sister would not give supporting depo.

Description: Plaintiff was returning home when he was suddenly pulled over by defendant officers who alleged he was speeding. Defendant Officers then breathalyzed him and even though he tested negative, he was tightly handcuffed, taken to the 28th precinct, searched, breathalyzed again, and then taken to the 32nd Precinct. It is unclear whether Plaintiff was actually charged with VTL 1192(1) 'Operating a motor vehicle while under the influence of alcohol or drugs' or whether he was released.
