Complaint
Description: On June 16, 2013, at approximately 5:50 p.m., plaintiff was in a park in Brooklyn, New York, when he was approached by NYPD officers, including officer Matthew Vitale, and accused of smoking marijuana. Plaintiff told the officers that he did not but despite a lack of evidence and no probable cause that he committed a crime, the officers arrested him, handcuffed him, and took him to the precinct. At the precinct, they falsely informed the Kings County District Attorney's Office that they had observed plaintiff "Tampering with Evidence." Plaintiff was arraigned after approximately 25 hours in custody and received an adjournment in contemplation of dismissal.
