Description: Plaintiffs David and Joey Fernandez were in an argument when Joey kicked his bedroom door down, and accidentally hit his brother's nose. Plaintiffs called an ambulance, and when it arrived, police officers also arrived at the scene. The plaintiffs explained the situation to the police officers and said that neither wished to press charges. Police officers arrested both plaintiffs, and when Joey Fernandez asked why, he was pushed to the ground and punched and then taken into a police car. Joey was then put in a chokehold inside the police car. On his way to the precinct, Joey was further brutalized by police officers. Complaint
Description: On or about January 4, 2013, Plaintiff Pantoja called police about a domestic dispute among Plaintiff Pantoja and Plaintiff Rhodes who were in a relationship and have a child in common. Officers arrived and asked Plaintiff Rhodes to step outside the premises to speak with him. Plaintiff declined and without any justification the Officers reached into the subject premises and physically pulled Plaintiff Rhodes outside the subject premises. NYPD Officer Rene Calzada subsequently placed Plaintiff Rhodes into an illegal chokehold. While in a chokehold, NYPD Officer Eddie Cabrera punched Plaintiff Rhodes in the eye and mouth, at which point he lost consciousness. Plaintiff Rhodes was then placed under arrest. Plaint...
