Complaint
Description: On Sept. 28, 2016, plaintiff was at the residence he rented a room in. A fire broke out in the building and FDNY responded and put out the fire. After it was put out, FDNY captain discovered narcotics in the bedroom at the top of the stairs on the third floor, which was not the room rented by plaintiff. Officers Osipowich and Jimenez responded and found additional narcotics, money and a loaded firearm. Osipowich then applied for a serach warrant, stating he had found plaintiff's wallet in the same room as the contraband and that he found plaintiff's checkbook and debit card in the room; all these claims were false. He repeated these claims to a grand jury, but plaintiff was acquitted of all charges.
