Description: On or around January 3, 2013, Plaintiff went to visit his newborn cousin on the third floor of his aunt’s apartment building. Officers forced the superintendent to open the vacant second floor apartment and another officer barged into his aunt’s apartment on the third floor and searched it. Plaintiff’s aunt repeatedly requested a warrant, and the officers failed to provide one. A detective from the second floor instructed officers on the third floor to bring Plaintiff downstairs, where Plaintiff was assaulted, slammed to the wall, and arrested. Plaintiff was taken to the 75th Precinct then on to Central Booking. All charges against Plaintiff were dismissed.
