Description: On or about March 23, 2023, Officer Akila Nanayakkara and Officer Edward Murphy approached Hassler, who had pulled over on the side of a residential street after hitting a pothole and fallen asleep after multiple Uber drivers cancelled before picking her up. Officer Murphy opened the passenger side door of Hassler's vehicle and woke her up, and Officer Nanayakkara asked if she had anything to drink that night, to which Plaintiff responded "no." Officer Nanayakkara told Officer Murphy multiple times that he did not smell alcohol on Hassler's breath and that she just looked tired. Despite this, Officer Nanayakkara and Officer Murphy continued to detain Hassler until a portable breathalyzer test arrived. When ...
