Description: On the evening of April 27, 2012, Plaintiff Boatwright was in the backyard of 167-02 Baisley Blvd. in Queens County, New York. He was there as an invitee with other people for a social function. On the same night, Defendant Police Officers were present to execute a search warrant for the subject premises. The Defendant Police Officers forcibly entered the premises with weapons drawn and then entered the rear yard where they encountered the Plaintiff seated with other invitees. The Plaintiff had his hands flat and in plain view on the table.
