Description: On October 27, 2020, Plaintiffs Olivia Wanebo and John Acosta attended a protest against police brutality in Kings County. Plaintiff Acosta was filming the officers stationed at the protest and witnessed an unnamed officer use their bicycle as a weapon against another protestor. Upon using his phone to record the incident, Defendant Captain Ramos shoved Mr. Acosta and stated that he was placing Mr. Acosta under arrest. Description: On September 4, 2010, Plaintiff was walking on the sidewalk when Defendant Officer Andrew Barton grabbed his arm and restrained him, using expletives to describe Plaintiff. When Plaintiff attempted to make a phone call, Defendant Detective David Vasquez took the phone, dropped it on the ground, and told Defendant Barton to arrest him. Plaintiff was arrested, handcuffed and taken to the 42nd Precinct. There Defendant Barton falsely swore charges for resisting arrest and disorderly conduct. All charges were dismissed by motion of the prosecution on April 24, 2012.
