Description: On February 18, 2016, plaintiff was in his apartment when someone rang plaintiff's doorbell saying he was from the post office and had a delivery for plaintiff. It was not plaintiff's regular mail man. The man placed the package in plaintiff's hands, and plaintiff noticed that his name was spelled backward on the package. Plaintiff tried to return the package but the man refused to take it back. Plaintiff saw his regular mailman in his building and had the package in his physical possession for less than one minute before he handed it to his regular mailman. Description: Defendant Officers banged on Plaintiff's door and when he answered, him and a friend were forced into the hallway and handcuffed. Officers searched their apartment, another apartment in the building, and their persons. Plaintiff was arrested, brought to the 34th Precinct, and charged with Possession of a Controlled Substance in the Third Degree and criminal use of drug paraphernalia in the second degree, which the DA declined to prosecute. Plaintiff, through FOIL, obtained the declined prosecution report which states they were "Unable to Establish Necessary Element of the Crime".
