Description: The plaintiff was driving when he was pulled over by the defendant officers without probable cause. The officers then searched the plaintiff's car claiming to smell marijuana, but no contraband was found. Fearing for his safety, the plaintiff ran down the street before giving up and surrendering. The officers had their pistols drawn and the plaintiff yelled "don't shoot." One of the defendant officers then approached the plaintiff and hit him in the head with his pistol. The plaintiff was taken to the hospital.
