Description: On September 26, 2012 an alleged robbery took place. As a result, conducted an unduly suggestive and illegal photo array using Plaintiff's mug shot from a prior arrest. As a result, a witness to the alleged robbery identified Plaintiff as the perpetrator. Plaintiff was not in New York State at the time of the alleged robbery. Officers went to Plaintiff's home without a warrant and forced their way in. The officers then arrested Plaintiff and took him to the precinct where he was involved in an unduly suggestive lineup. The witness did not identify Plaintiff in the lineup, however, Plaintiff was detained for over a day before being released without charge.
