Description: On May 15, 2017, plaintiff was walking down the street when he was hit by a stray bullet intended for members of a gang. Plaintiff was taken to a hospital, where NYPD Detective Bernard Solomon, Officer Edwin Baez, and Detective Sean Smith searched plaintiff and seized his clothes and cell phone, which were never returned to him. Without justification, Sergeant Ventura, NYPD Detective Solomon, Captain Pinkhasov, Detective Jeffrey Scalf, Sergeant Leo Nugent, Detective Smith, Detective Chandler, Detective Mendez, and Officer Baez, labeled plaintiff a “gang member” and placed him in the NYPD’s gang database.
