Description: On June 29, 2018, at approximately 9:00 p.m., Bobby Ruiz was on the J-Line Subway train at the Broadway Junction MTA Station in Brooklyn, NY, traveling back from a fishing trip and carrying his fishing gear. NYPD officers, including Mohammad Shabaz, Raphael Sylvestre, and Sergant Wiss Emile, approached the plaintiff without reasonable suspicition and asked him to use a different staircase in the subway station. He complied, but defendant Shabaz grabbed him by the neck and threw him to the ground. The police then searched him without his consent, handcuffed him, and placed him under arrest.
