Description: On November 2, 2013, the plaintiff and his girlfriend exited his apartment building around 3:00PM and were approached by PO Vega and Sgt. Diaz, who issued a summons for plaintiff's girlfriend. While issuing the summons, POs Tavarez and Perez also arrived. When plaintiff asked why they were issuing a summons, PO Tavarez pushed plaintiff against a metal fence and placed him under arrest. Tavarez forcefully jostled the plaintiff and shoved him into the fence several times. POs Perez and Vega and Sgt. Diaz assisted Tavarez in pushing plaintiff, striking plaintiff in the back while he was pinned against the fence.
