Complaint
Description: Plaintiff was a passenger in a green taxi traveling from Brooklyn to 125th Street in Manhattan. The taxi stopped at 414 West 42nd Street. Plaintiff fell asleep and woke up to a police officer flashing a light in his face. Plaintiff was then ordered out of the vehicle and was told that he would be arrested if he did not pay the taxi fare. Plaintiff immediately paid the fare, but then took out his phone in an attempt to document their badge numbers. Officers then placed him in handcuffs and arrested him for attempted assault.

Description: Plaintiff was operating a food cart when the cart's umbrella blew onto a nearby vehicle waiting at the curb. The owner of the car could not find any damage to the car, however, when the owner's son came out of the Javits Convention Center to meet his mother, he demanded that the plaintiff pay them $300 and threatened to call the police if he did not pay. Plaintiff did not pay the $300 and police were called. Officers arrived and began to intimidate and threaten the plaintiff, handcuffed him and forced him to pay $200. The officers also threatened that if he did not pay them, he would be arrested for reckless endangerment. Once he paid, the handcuffs were removed.
