Description: On December 31, 2012, plaintiff was lawfully within his home located on 98th Street, Queens, New York. During late evening, plaintiff's neighbors were making loud noise for an extended period of time. Plaintiff went downstairs, knocked on their door, and asked them to keep the noise down. Plaintiff left and returned to his apartment, never having entered their apartment. Several officers including defendant McLoughlin knocked on his door and told him his neighbor called police and made a complaint. Plaintiff insisted that he had done nothing wrong.
