Description: On December 14, 2020, the plaintiffs were in their vehicle when PO Matthew Miret and certain unidentified PO illegally assaulted, battered and arrested without any probable cause. The plaintiff's vehicle was seized without probable cause and the plaintiffs were handcuffed tightly. The plaintiffs were taken to the 40th Precinct and without being provided with Miranda warnings were questioned about if they were part of any gangs. The plaintiffs were then released with Desk Attendance Tickets for marijuana possession despite no marijuana being found on the plaintiffs. The charges against the plaintiffs were dismissed on April 28, 2021.

Description: On June 27, 2018, Infallible Davis was coming from a get together in the area of East 169th Street and Boston Road in the Bronx County. As Mr. Davis was walking along Washington Avenue, NYPD Officers Miret and Marcellus yelled at Mr. Davis as they drove by. After having been harassed by NYPD in the past and considering he was alone at 4:30 a.m., Mr. Davis ran away. Around 1075 Washington Avenue the Defendant Officers caught up with Mr. Davis and struck him with their vehicle. Mr. Davis was hit so hard, his sneaker came off and he lied on the ground in significant pain. Subsequently he was handcuffed by the Defendant officers and waited for an ambulance.
