Description: On April 3, 2018, between 11:00 pm and midnight, Mr. Ragin was operating a motor vehicle on Neilson Street (close to Dinsmore Avenue). Defendant Officers (Officers Napoli and Peveraro) stopped Mr. Ragin’s vehicle, directed him out of the vehicle, and conducted a search of it – they then arrested Mr. Ragin and charged him with violation of vehicular and traffic law. Because of this, Mr. Ragin was arraigned on the night of April 4, 2018. Mr. Ragin was subsequently prosecuted in Queens County Criminal Court – there, Officer Napoli gave testimony to the effect that he observed Mr. Ragin driving a vehicle with an air freshener obstructing the vehicle’s front windshield and that he observed marijuana smoke coming fro...
